Subscription Terms

Please read these Subscription Terms (the “Subscription Terms”) carefully as they govern your (“user(s)”, “you” or “your”) access to and use of subscription-based services (the “Subscription”) made available in our mobile applications, software products, content and updates offered by us (“Software Products”), and contain important information about your legal rights, remedies and obligations.

Capitalized terms not defined herein shall have the meanings set forth in the Terms of Service. In the event of any conflict between these Subscription Terms and the Terms of Service, the Terms of Service shall prevail.

By purchasing, accessing or using a Subscription, you agree to be bound by these Subscription Terms. If you do not agree, do not purchase or use any Subscription.

If you purchase a Subscription for our games via a third-party platform  such as Apple App Store or Google Play, the platform will charge you for the subscription fees and the applicable platform’s payment and subscription terms and conditions shall apply. Please review the appropriate platform’s payment terms and conditions for additional information.

1. Eligibility

You must be at least 13 years old (or such other minimum age as is applicable in your country of residence) to purchase or use a Subscription.

If you are under the age of 18 (or the age of majority where you live), you represent that your parent or legal guardian has reviewed and agreed to these Subscription Terms on your behalf and assumes responsibility for your use of the Subscription.

2. Subscription

We may offer certain in-game benefits, virtual items or features through periodic subscription services. The specific content, duration, price and benefits of each Subscription will be presented to you at the time of purchase.

Subscription benefits are provided only within the applicable Software Product and have no cash value and may not be exchanged for real-world money or items.

We reserve the right to modify the content or benefits of a Subscription from time to time in accordance with applicable law. A Subscription does not guarantee the availability or continued offering of any content, features, updates, or benefits.

3. Fees and Billing

The applicable subscription fees and billing period will be disclosed to you prior to purchase. Subscription fees may be subject to applicable taxes, duties, or governmental charges, which will be disclosed to you at the time of purchase.

Unless otherwise stated, all Subscription fees are charged in advance on a recurring basis (e.g., monthly or annually) and will be billed through the applicable third-party platform or payment provider (such as Apple App Store or Google Play).

You authorize us and/or the relevant platform provider to charge your selected payment method for all applicable Subscription fees. If we or the applicable platform provider are unable to collect the applicable fees or charges due for your Subscription, we may suspend or terminate your access to the Subscription.

4. Auto-Renewal

Unless you cancel your Subscription before the end of the current billing period, your Subscription will automatically renew for an additional term of the same duration at the then-current price.

You acknowledge and agree that your payment method will be charged automatically at the beginning of each renewal period unless you cancel your Subscription in accordance with Section 6 below. We or the applicable platform will provide you with any renewal or expiration notices required by applicable law or platform policy. Such notices may include, where applicable, reminders regarding auto-renewal or advance notice prior to a renewal billing.

5. Changes to Price or Subscription Content

We may change the price or content of a Subscription from time to time in accordance with applicable law.

If we plan to increase the Subscription fees or make material changes to the Subscription terms, we or the applicable platform will notify you in a clear and timely manner before the change takes effect, or as otherwise required by applicable law or platform policies (such as Apple or Google). Where such change triggers a legal or platform requirement for consent, we will obtain your express consent before continuing the Subscription at the new fees. If consent is not provided, or where required by law, you will have the right to cancel the Subscription without penalty. Any changes to Subscription benefits will generally take effect at the start of a new billing period.

6. Cancellation

You may cancel your Subscription at any time through the relevant third-party platform (such as Apple App Store or Google Play) or through the account management tools made available in the Software Product, if applicable.

Cancellation will take effect at the end of your current billing period. You will continue to have access to the Subscription benefits until the expiration of the then-current term.

Deleting your account or uninstalling the Software Product does not automatically cancel your Subscription.

If you cancel your Subscription more than 24 hours before the end of the then-current Subscription term, the cancellation will take effect at the end of that term, and you will not be charged for any subsequent Subscription period. You may continue to use the Subscription until the end of the then-current term.

If you cancel your Subscription less than 24 hours before the end of the then-current Subscription term, the Subscription will renew for one additional term, and you will be charged for that renewal. In that case, you may continue to use the Subscription through the end of the renewed term, after which the Subscription will be cancelled and no further charges will apply.

You may cancel the auto-renewal of a Subscription via the relevant third-party platform by following the steps below on your device:

7. Refunds

Except as required by applicable law or by the policies of the relevant third-party platform, all Subscription fees are non-refundable and there are no refunds or credits for partially used Subscription periods. This no-refund policy does not affect any rights you may have under APPLICABLE consumer protection laws.

If you purchased your Subscription through a third-party platform, any refund requests are subject to that platform’s applicable refund policies (such as Apple App Store or Google Play).

8. Suspension or Termination

We reserve the right to suspend, terminate or cancel your Subscription and/or your access to Subscription benefits if:

(a) you violate these Subscription Terms or the Terms of Service;
(b) your account is suspended or terminated; or
(c) we discontinue the applicable Subscription or Software Product.

Upon termination or expiration of your Subscription, any unused Subscription benefits will be forfeited without compensation.

9. No Transfer or Resale

Subscriptions and any related benefits are personal to you and may not be transferred, sold, gifted, sublicensed or otherwise assigned to any third party.

10. Disclaimer

Subscriptions are provided on an “AS IS” and “AS AVAILABLE” basis. We do not guarantee that any Subscription or its associated benefits will be available at all times or free from interruption.

We may modify, suspend or discontinue any Subscription at any time in accordance with these Subscription Terms and applicable law.

11. Governing Law and Dispute Resolution

These Subscription Terms are governed by and shall be interpreted in accordance with the governing law and dispute resolution provisions set forth in the Terms of Service, which are incorporated herein by reference.
